Welcome to the Mutual Gains Negotiations web site developed in partnership with the Pennsylvania Department of Transportation (PennDOT) and the American Consulting Engineers Council of Pennsylvania (ACEC/PA ). In 2006, concerned with the length of time it takes to execute contracts, the Joint PennDOT/ACEC/PA Transportation Task Force (Task Force), began investigating a process for negotiating contracts that fosters a true sense of partnership among the parties, called Mutual Gains Negotiations. Some of the anticipated benefits of this new process include a significant reduction in negotiation and project delivery; consistency with negotiations statewide; and the mutual understanding of expectations regarding scope, deliverables, range of hours and project complexity. As the name implies, the goal of mutual gains negotiation is to make certain that all parties involved gain from the negotiations.

The initial tools currently being developed to assist in that effort are Standard Procedures for Scope Clarification Meetings and a Staff Hour Estimating Guide. This website is intended to provide PennDOT and ACEC/PA members with project updates and results. We hope you find this information useful.
